DUI/DWI

The consequences of DUI, DWI and OWVI are influenced by your age, blood alcohol content (BAC), prior criminal history and whether you caused injury or death during the operation of a vehicle. Although you are under no obligation to perform any standardized field sobriety test, you are obligated to take a chemical test if the officer finds probable cause. Assault/Battery

Assault is a threatened or attempted physical attack against another by a person who appears to have the ability to cause bodily harm. Battery is the act of using force against another person which results in either bodily injury or offensive touching, and does not need to be intentional; force applied with criminal negligence is sufficient to be considered battery. Domestic Violence

Domestic Violence is physical violence, threatened violence, and abuse which occurs in the following relationships:

Married Couples (also known as Spousal Abuse)
Cohabiting Couples
Persons who have a child or children in common
Persons in a dating relationship or where in a former dating relationship
Persons who were formerly married to each other

Homicide/Murder

Homicide is the killing of one person by another, classified as

Justifiable homicide, occurring as a result of the reasonable belief that a serious crime is being committed, and in an attempt to prevent the crime, or in self-defense or defense of others
Excusable homicide, committed accidentally or with sufficient provocation
Criminal homicide, including murder and voluntary and involuntary manslaughter

Fraud

Fraud is defined to be "an intentional perversion of truth" or a "false misrepresentation of a matter of fact" which induces another person to "part with some valuable thing belonging to him or to surrender a legal right". However, fraud can also be charged for breaking of very specific regulatory laws. Our attorneys are experienced in finding an appropriate defense in even the most complicated fraud cases.

Criminal Appeals

There are numerous reasons for an appeal from a guilty verdict in a criminal case, including what's called "legal error." Legal error may include:

Allowing inadmissible evidence during the criminal process, including evidence that was obtained in violation of your constitutional rights
Lack of sufficient evidence to support a verdict of guilty
Mistakes in the judge's instructions to the jury regarding your case

Bail Bond Hearings

Bail is money or property put forth as security to ensure that you'll show up for further criminal proceedings. In Indiana, bail can be paid: In cash, with a pledge of property (if permitted in that court) or a bail bond. A professional bail bondsman is an individual whose business is to pledge his or her own property or security to guarantee the bail bond to the court.
